Welcome to West Shore Studio. These Terms & Conditions apply to your use of westshorestudio.com and to photography services booked through West Shore Studio.
By using this website, submitting an inquiry, booking a photography session, or purchasing photography services from West Shore Studio, you agree to these Terms & Conditions.
1. Photography Services
West Shore Studio provides portrait and family photography, event photography, commercial and product photography, and related photography services.
The specific services, session length, number of images, pricing, location, deliverables, and other details included with your booking will be based on the package selected or the individual agreement provided to you.
Custom projects may be subject to additional terms agreed upon in writing.
2. Booking & Deposit
A non-refundable $75 deposit is required to reserve your photography session.
The deposit is applied toward the total cost of your session.
Your session date and time are not considered reserved until the deposit has been received.
3. Remaining Balance
The remaining balance is due before your edited images are delivered.
Final edited images will be released once payment has been received in full.
For commercial projects, events, or custom photography assignments, a different payment schedule may be provided in writing before the project begins.
4. Rescheduling
If you need to reschedule your session, please notify West Shore Studio at least 48 hours before your scheduled session.
With at least 48 hours’ notice:
Your session may be moved to another available date at no additional charge.
Your existing deposit will be transferred to the new booking date.
If you provide less than 48 hours’ notice, a new $75 deposit may be required to reserve another date.
5. Cancellations
Deposits are non-refundable.
If you cancel or reschedule with at least 48 hours’ notice, the deposit may be transferred to a new session date.
Cancellation of the session does not entitle the client to a refund of the deposit.
6. No-Shows & Late Arrivals
Clients who do not arrive for their scheduled session and do not provide notice will forfeit their deposit.
If you arrive late, your photography session may need to be shortened if another session or commitment is scheduled afterward.
A late arrival does not automatically extend the scheduled end time of the session.
7. Weather for Outdoor Sessions
If weather conditions make an outdoor photography session impractical or unsafe, West Shore Studio may reschedule the session at no additional charge.
Your existing deposit will transfer to the rescheduled date.
Weather-related rescheduling will be determined based on the conditions affecting the planned photography location.
8. Payment Methods
West Shore Studio accepts:
Credit or debit card through secure online checkout
Venmo
Zelle
The deposit is collected when the session is booked. The remaining balance may be paid using any accepted payment method before the final images are delivered.
9. Photography Style & Editing
By booking West Shore Studio, you acknowledge that you have reviewed the photographer’s work and understand the general photographic and editing style.
West Shore Studio retains creative discretion regarding matters including image selection, composition, cropping, color correction, retouching, and final editing.
Not every photograph taken during a session will be delivered. Images that are duplicates, test shots, technically unsuitable, or otherwise not selected as part of the final collection may be removed during the selection process.
Unless specifically included in your package or agreed to in writing, unedited or RAW image files are not provided.
10. Image Delivery
The number of edited images provided will depend on the photography package or custom agreement selected.
Images are generally delivered digitally through an online gallery or another delivery method communicated to the client.
Delivery time may vary depending on the type and size of the photography project.
Any specific delivery deadline agreed to for a project should be confirmed in writing.
11. Client Cooperation
The client is responsible for arriving on time and providing reasonable cooperation necessary to complete the photography session.
For events, commercial projects, or sessions at third-party locations, the client is responsible for obtaining any required access or permissions unless otherwise agreed in writing.
West Shore Studio cannot guarantee particular photographs when circumstances outside the photographer’s control prevent those photographs from being created.
12. Children and Minors
A parent, legal guardian, or responsible adult must supervise minors as appropriate during photography sessions.
A parent or legal guardian is responsible for providing any permission required for a minor to participate in a photography session.
Photographs of minors will not be used by West Shore Studio for promotional purposes solely because a photography session was booked. Any promotional or portfolio use requiring permission should be addressed separately through appropriate consent or a model release.
13. Copyright
Unless otherwise agreed in writing, photographs created by West Shore Studio remain copyrighted works of West Shore Studio.
Purchasing a photography session or receiving digital images does not transfer the copyright in those photographs to the client.
14. Personal Use License
For portrait, family, and other personal photography sessions, clients receive permission to use delivered photographs for ordinary personal purposes, including:
Printing photographs for personal use
Sharing photographs with family and friends
Posting photographs on personal social media accounts
Using photographs for personal profiles and similar non-commercial purposes
Clients may not sell, license, substantially alter, or use the photographs for commercial advertising without written permission from West Shore Studio.
15. Commercial Photography
Commercial and product photography may include specific usage rights or licensing terms.
The permitted use of commercial photographs will be determined by the package selected, project proposal, invoice, or other written agreement between the client and West Shore Studio.
Unless expressly stated otherwise, purchasing commercial photography services does not automatically transfer copyright ownership to the client.
16. Portfolio & Promotional Use
West Shore Studio may request permission to display selected photographs in its portfolio, website, social media accounts, advertising, or other promotional materials.
Where separate client permission, consent, or a model release is required or requested, that authorization will be handled separately from these Terms.
Booking a session does not by itself constitute a blanket model release.
17. Equipment Failure, Illness & Circumstances Beyond Our Control
West Shore Studio will make reasonable efforts to perform all booked photography services as scheduled.
If a session cannot be completed because of photographer illness, equipment failure, severe weather, emergency, location closure, or another circumstance outside reasonable control, West Shore Studio may reschedule the session.
If West Shore Studio is unable to provide the booked service and an appropriate rescheduled date cannot reasonably be arranged, payments made for services that were not provided may be refunded.
18. Website Content
All photographs, graphics, text, branding, logos, and other original content displayed on westshorestudio.com are owned by West Shore Studio or used with permission unless otherwise indicated.
Website content may not be copied, reproduced, republished, distributed, or used commercially without permission.
19. Third-Party Services
The West Shore Studio website may use or link to third-party services such as online payment providers, social media platforms, scheduling tools, analytics providers, or gallery services.
Those third parties may operate under their own terms and privacy policies.
West Shore Studio is not responsible for the content, availability, or privacy practices of independent third-party websites and services.
20. Limitation of Liability
To the fullest extent permitted by applicable law, West Shore Studio will not be responsible for indirect, incidental, or consequential losses arising from the use of this website or photography services.
Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited under applicable law.
21. Changes to These Terms
West Shore Studio may update these Terms & Conditions from time to time.
When changes are made, the updated version will be posted on this page with a revised “Last Updated” date.
